Terms of Service

1. Who we are

This website is operated by Cubensis Consulting LLC ("Cubensis Consulting", "we", "us"), a business consulting and optimization company based in Miami, Florida, USA.

2. Services

We provide business consulting and optimization services. The scope, deliverables, timeline and fees of each project are defined in writing in a proposal or service agreement that the client approves before work begins.

3. No guarantee of results

Results depend on factors specific to each business and on how recommendations are implemented. We do not guarantee any specific figures, sales or savings.

4. Client responsibilities

The client agrees to provide accurate and complete information, to give timely access to the people and data needed, and to review deliverables within a reasonable time.

5. Payments

Fees are invoiced as agreed in the proposal. Payments are processed by third-party payment providers; we do not store your full payment card details.

6. Confidentiality

We treat client information as confidential and do not disclose it to third parties without authorization, unless required by law.

7. Intellectual property

Deliverables created specifically for the client become available for the client's use once paid in full. We retain ownership of our pre-existing methodologies, templates and tools.

8. Limitation of liability

To the maximum extent permitted by law, Cubensis Consulting's total liability to the client is limited to the fees paid for the service giving rise to the claim. We are not liable for indirect or consequential damages.

9. Governing law

These terms are governed by the laws of the State of Florida, USA.

Privacy Policy

What information we collect

The information you send us by email, WhatsApp or on calls (for example, your name, contact details and business information) and what is needed to invoice our services. This website does not use advertising cookies or third-party tracking tools.

How we use it

To respond to your inquiries, prepare proposals, deliver and invoice the services you hire, and comply with legal obligations.

Who we share it with

We do not sell your personal information. We share it only with providers that help us operate (for example, email, scheduling and payment processing) and when required by law.

Retention and your rights

We keep information for as long as needed for the purposes described. You may request access to, correction of or deletion of your data by emailing christian@cubensisconsulting.com.

Security

We apply reasonable measures to protect the information you entrust to us, although no method of transmission or storage is completely secure.

Changes

We may update this policy. The date of the latest update appears at the top of this page.

Refunds & Cancellations

Fees and payment schedule

The fees and payment schedule for each project are set out in the proposal approved by the client.

Cancellation before work begins

If you cancel before work begins, we refund what you paid, less any non-refundable deposit expressly stated in the proposal.

Cancellation once work is underway

Work already performed is billed. Payments corresponding to work that has not yet started are refunded proportionally.

Issues with a deliverable

If you have a problem with a deliverable, let us know in writing within 14 days of receiving it and we will fix it at no additional cost within the agreed scope.

How to request a refund

Email christian@cubensisconsulting.com with the service you hired and the reason. We respond within 5 business days, and approved refunds are returned to the original payment method.
